Место и значение норм международного права в системе источников гражданского процессуального права

В статье рассматриваются нормы международного права как источники гражданского процессуального права. Автор исследует понятия общепризнанных норм и норм «jus cogens». Анализируется положение ч. 2 ст. 1 и ч. 4 ст. 11 ГПК РФ, и делается вывод о том, что нормы международного права в качестве источников российского права применяются в ходе судопроизводства и по его итогам. Кроме того, рассматривается вопрос о месте международных договоров в иерархии источников гражданского процессуального права в зависимости от сферы действия. Помимо прочего, поднимаются и иные проблемы реализации норм международного права в качестве источников гражданского процессуального права. Принцип международного сотрудничества в сфере гражданского судопроизводства приобретает практическое значение при рассмотрении трансграничных гражданских дел, в частности вопросов исполнения судебных поручений, признания и исполнения решений российских и иностранных судов. Сотрудничество на межнациональном уровне берет свое начало в постулате равенства государств, их уважительном отношении друг к другу, оказании взаимной помощи иностранным лицам в осуществлении защиты своих гражданских прав.
