В настоящей статье рассматриваются проблемы правосудия в современных
условиях с точки зрения общественных ожиданий, а также условия, при кото-
рых оно неизбежно пребывает в кризисе либо имеет все возможности для своего
развития. Судебная защита прав и свобод – основополагающая функция судеб-
ной власти, на суд возлагается особая миссия, и ее эффективное осуществление
возможно при реализации принципа разделения властей на законодательную,
исполнительную и судебную. На суд ложится нагрузка по исправлению дефектов
нормативно-правовой системы; повседневная деятельность судов по разреше-
нию споров, рассмотрению гражданских и уголовных дел направлена на обеспе-
чение прав и свобод граждан. Авторы обозначают проблему прямого и косвенно-
го судебного нормоконтроля. Суду удобнее рассмотреть вопрос о соответствии
либо несоответствии в той или иной части подзаконного нормативного пра-
вового акта федеральному закону в рамках самостоятельного судебного разби-
рательства, в то время как понимание конституционного права на судебную
защиту, напротив, указывает на необходимость скорейшего восстановления
нарушенного права. Судебная реформа мыслится не иначе, как в русле укрепления
государственности, и, по мнению авторов, она обречена на провал, если судебную
реформу не связывать с административной, не вписывать ее в общий контекст
правотворчества и правоприменения.
