НОВАЯ КАССАЦИЯ ПО ГРАЖДАНСКИМ ДЕЛАМ:

Гражданский процесс находится в процессе реформирования, одним из масштаб-
ных изменений стал новый порядок производства в кассационном суде общей
юрисдикции. В речевой оборот юристов вошло понятие «сплошная кассация»,
что, однако, мало объясняет суть произошедшего изменения: не вполне ясно, что
же в результате изменилось? В статье рассматриваются вопросы завершения
очередных этапов судебного реформирования, анализируются итоги создания
в системе судов общей юрисдикции кассационных судов, изменения кассацион-
ного порядка рассмотрения дел в гражданском процессе, выявляются положи-
тельные и отрицательные стороны произошедших в судебной системе и судо-
производстве изменений, проводится сравнение с опытом российского судебного
реформирования 1864–1917 гг. Практика судов кассационной инстанции вызы-
вала постоянную обоснованную критику в профессиональной юридической сре-
де и недовольство граждан качеством отправления правосудия по гражданским
делам. Автор предпринимает попытку объяснить нововведения и проводит срав-
нение терминов и процедур. В статье прогнозируются процессуально-правовые
последствия начала деятельности новых судов общей юрисдикции. Отдельное
внимание уделено вопросам теории кассационного производства, а именно поня-
тию, видам и классификации современных кассационных производств. Рассма-
тривается зарубежный опыт.
