В статье раскрывается история изучения советского гражданского судопроиз-
водства. В советское время большинство работ были посвящены практическим
аспектам гражданского процесса. Ученые исследовали отдельные институты
процесса, подчеркивали его роль в строительстве социалистического государ-
ства. Процессуалисты 1950-х–1980-х гг. активно развивали теорию гражданского
судопроизводства (А.Ф. Клейнман, Н.А. Чечина, М.Х. Хутыз). В 1990-е гг. интерес
к советскому процессу почти отсутствовал. В лучшем случае ученые составля-
ли маленькие исторические справки. Зачастую переписывались нормы двух ГПК
РСФСР. Ситуация изменилась в следующее десятилетие. Выходит серия научных
работ по процессу вообще и по истории в частности. Но в данный период наука
пока в основном накапливала знания. Качественный переход произошел в 2010-е гг.
В настоящее время историко-правовая наука переходит к активному и глубо-
кому исследованию специфических особенностей гражданского судопроизводства
в Советской России. Ученые приступили к изучению советского опыта судопроиз-
водства сразу же по нескольким направлениям: одни подошли к советскому перио-
ду с доктринальных позиций (Д.Я. Малешин); другие устанавливают связь процес-
са имперского и советского (В.Н. Тарасов); третьи вписывают судопроизводство
в общий контекст развития советского общества (В.В. Никулин); четвертые
исследуют положение прокурора при рассмотрении гражданских дел (В.Р. Аликов
и А.З. Зольников); пятые сосредоточились на изучении отдельных стадий процесса
(Д.С. Исакова, С.Ю. Яковлев, Е.А. Нахова, Е.В. Дремова, А.А. Селькова, А.С, Моро-
зова и др.). Наконец, промежуточный итог, своего рода обобщение современных
достижений науки содержится в исследованиях М.О. Доловой, обобщившей споры
советских процессуалистов о сущности гражданского процесса.
