ПРАВОСУДИЕ В КОНЦЕПЦИИ УСТОЙЧИВОГО РАЗВИТИЯ

Постановка глобальной цели № 16 «Содействие построению миролюбивого и откры-
того общества в интересах устойчивого развития, обеспечение доступа к право-
судию для всех и создание эффективных, подотчетных и основанных на широком
участии учреждений на всех уровнях» в Повестке дня в области устойчивого разви-
тия на период до 2030 года Организации Объединенных Наций1 и отсутствие еди-
ного понимания категорий «устойчивое развитие», «верховенство права» в России
обусловливают необходимость анализа названных понятий для действенного обе-
спечения доступа к суду и службе судебных приставов, роста правовых гарантий
в правилах судопроизводства. Проблема решается с использованием методов ана-
логии, дедукции и обобщения, исторического, систематического и логического тол-
кования, диалектического и технико-юридического методов. Совокупность назван-
ных методов позволяет сделать вывод, что юридическая наука сегодня не обладает
релевантным понятием «устойчивое развитие» правосудия России, что мешает
формировать государственную программу развития судебной системы с реальными
мерами роста правовых гарантий в судопроизводстве и обеспечивать подотчет-
ность всех учреждений юстиции, подлинный доступ в суд и службу судебных при-
ставов. Нет истинного понимания категории «верховенство права», что затруд-
няет его воплощение в жизнь. Для восполнения пробела знаний нужны специальные
программы обучения и курсы повышения квалификации государственных служащих,
повседневная деятельность которых должна соответствовать принятым стан-
дартам справедливого судебного разбирательства и хорошего управления.
