Автор статьи анализирует судебную практику в области многоаспектной про-
блемы защиты от нормативных актов как способа борьбы с несправедливостью.
В статье проводится анализ правил, закрепленных в КАС РФ. Автор выражает
сожаление о том, что порой суды пытаются при разрешении сложных вопросов
идти по наилегчайшему пути – уклоняясь от их разрешения. Ценным является
комментарий разработчика некоторых норм, включенных в ГК РФ, Н.И. Клейн.
В частности, автор приводит в пример ч. 11 ст. 213 КАС РФ, которая закрепи-
ла правило: «Утрата нормативным правовым актом силы или его отмена в пери-
од рассмотрения административного дела об оспаривании нормативного правово-
го акта не может служить основанием для прекращения производства по этому
административному делу в случае, если при его рассмотрении установлены при-
менение оспариваемого нормативного правового акта в отношении администра-
тивного истца и нарушение его прав, свобод и законных интересов», и указывает
на то, что при всей позитивности данной нормы в ней заложена определенная воз-
можность не увидеть нарушение прав, свобод, законных интересов заявителя и пре-
кратить производство по делу.
