В СУДЕБНОМ ПРОЦЕССЕ

Статья посвящена исследованию правовых, технических и фактических возмож-
ностей задействования юнитов искусственного интеллекта в судебном процес-
се – как компаньона судьи или адвоката, а также как электронного судьи. Авто-
ром показаны основные тенденции, связанные с применением искусственного
интеллекта в судебном процессе. В статье раскрыто понятие искусственного
интеллекта в контексте его применения в системе гражданского судопроизвод-
ства. Автор исследует принципиальную возможность и необходимость приме-
нения технологий искусственного интеллекта в гражданском процессе, а также
возможные направления использования искусственного интеллекта в граждан-
ском судопроизводстве. Описаны преимущества и риски применения технологий
искусственного интеллекта в судопроизводстве в силу того, что повсеместное
внедрение технологий такого рода еще не началось, изложены потенциальные
теоретические аспекты использования искусственного интеллекта, направле-
ния и формы задействования юнита искусственного интеллекта (как «компа-
ньона» судьи) в судопроизводстве, в гражданском, арбитражном, администра-
тивном, уголовном процессах, а также в арбитражном третейском процессе. Дан
анализ проблем, связанных с определением применимых норм права и их понима-
нием и толкованием, которые следует учесть при разработке и внедрении новых
технологий в традиционный процесс.
