В статье дается обзор действующего международного правового режима при-
знания и приведения в исполнение иностранных судебных решений в правопоряд-
ках государств – членов ЕАЭС, а также некоторых особенностей национальных
режимов признания и приведения в исполнение иностранных судебных решений.
В статье рассматриваются и сравниваются различные системы признания
иностранных судебных актов. Проводится анализ действующих многосторон-
них соглашений, на основании которых осуществляется признание и приведение
в исполнение, а именно Киевское соглашение, Минская конвенция, Московское согла-
шение, Кишиневская конвенция. Рассматриваются некоторые особенности наци-
онального регулирования института признания и приведения в исполнение в пра-
вопорядках государств – членов ЕАЭС. Обосновывается тезис о противоречивом
и устаревшем характере международно-правового режима, который не отвечает
целям современной степени интеграции государств в формате ЕАЭС. Авторами
формулируются выводы о том, что институт признания и исполнения судебных
решений выступает в качестве отправной точки для процесса интеграции, тем
не менее в результате создания различных по содержанию механизмов признания
и приведения в исполнение судебных решений в ряде многосторонних соглашений
стран – членов ЕАЭС единый подход так и не был выработан.
