Procedural Offence: The Concept and Characteristics

The article examines the concept and characteristics of a procedural offence based on the general characteristics of an offence, as they correlate to each other as the categories of genus and species. Therefore, the characteristics inherent to the general concept have a peculiar interpretation in the specific concept. The article studies such characteristics of a procedural offence as an action, blame; illegality; punishability. Special attention is given to the most controversial characteristics of a procedural offence – punishability and guiltiness, as well as to certain characteristics of an action. The authors base their approach on a narrow view of a legal process and believe that a legal process does not necessarily exist everywhere where there is a legal procedure. The concept of a procedural offence is defined under this approach. Considering blame as a general characteristic of an offence, the authors concede some exceptions as applied to procedural offences. This conclusion is based on the legal position of the Constitutional Court of the Russian Federation which points out that an exception from the principle of guiltiness must be clearly expressed in the law. However, this is an exception and not a general rule. Thus, the concept of a procedural offense should involve the characteristic of blame. The authors come to a conclusion that a procedural offense is an illegal guiltily committed socially dangerous act which is committed by a legally accountable subject and there is a procedural responsibility provided for committing such an act.
