The author of the article conducts a survey on features of public order application by People’s Courts of China in cases on recognition and enforcement of foreign arbitral awards. On the national level of China legislation there is direct renvoi to statements of the New- York Convention on the Recognition and Enforcement of Convention Foreign Arbitral Awards. According to that statements of the Convention go in force and they are applied in China directly. Mostly, the attention of the author is paid to development of the term “public order” in China; the peculiarities of Chinese legislation relating to the public order and its application: as there is no term illustration of “public order” both in the New-York Convention and the UNCITRAL Model Law on International Commercial Arbitration of 1985, it means there is the right of states to interpret the concept. The author also shows the establishment process of the “report system” by the Supreme Court of China, judicial practice of the People’s Courts of China for cases on public order application and forming an approach on public order scope interpretation as well as suggestions to conduct reforms in the mentioned sphere of Chinese legislation.
