The Categories of Cases Referred to Summary Proceedings: The Integration of Warrant and Contentious Jurisdiction

In the article the author analyzes the categories of cases referred to summary proceedings. He explains the issues not regulated in the decree of the Plenum of the Supreme Court of the Russian Federation of 18 April 2017 No. 10 «On Some Questions of Application by Courts of Provisions of the Civil Procedure Code of the Russian Federation and the Arbitration Procedure Code of the Russian Federation on Summary Proceedings». Despite the clarifications of the Supreme Court of the Russian Federation on the categories of cases considered in simplified procedure, there are many questions in practice on the possibility of classifying specific cases to those under consideration in a simplified manner. It is concluded that reform of institutions of expedited proceedings in civil procedure is moving towards compulsory application. The role of the will of the participants of the process in choosing forms of protection decreases, the legislator departs from the optional use of such types of production. Integrated essence of summary proceedings necessitates a careful differentiation of cases, relating to consideration in a simplified procedure, from cases in warrant and contentious proceedings.
