Retrospective of the Legal Positions of the Plenum of the Supreme Court of the Russian Federation in Administrative Proceedings

The author considers particular moment of administrative proceedings in Russia – retrospective of the legal positions of the Plenum of the Supreme Court of the Russian Federation in administrative proceedings. It is noted that the Constitutional Court of the Russian Federation admits retrospective of decisions of the higher judicial instances if they improve the situation of citizens and their associations in disputes from public legal relations, but as for private disputes retrospective of legal positions will violate the principle of legal certainty and make worse the situation of one of disputing parties, that is why the possibility of retrospective of legal positions of higher courts is limited, and it is allowed only in exceptional cases. The author gives examples of his own practice and also of practice of the Court of the European Communities which considered the question of retroactivity of its acts. There is also an accent put for guaranteeing the principle of legal certainty and stability of civil turnover, taken by the Constitutional Court of the Russian Federation.
