Problems of Certainty of International Jurisdiction Agreements: Comparative Study of Russian and French Legal Regulation

In the article the problems of validity of international jurisdiction (prorogation) agreements establishing the competence of the Russian courts with regard to compliance of such agreements to the requirement of certainty are considered, the provisions of legislation, court practice and doctrine of Russia and France in the sphere of the international jurisdiction agreement are analyzed. Existing problems of validity of international jurisdiction (prorogation) agreements in Russia are connected, in particular, with absence of the uniform court practice of applicability of the requirement of certainty of such agreements. The author comes to a conclusion that the most reasonable way to solve the problems of validity of international jurisdiction (prorogation) agreements existing in Russia is adoption by the Plenum of the Supreme Court of the Russian Federation the rule, clarifying the issues of the application of the Russian legislation in force in the sphere of assessment
of validity of international jurisdiction (prorogation) agreements with the aim to secure the uniform court practice of application of the corresponding provisions of the Russian Arbitration Procedure Code and Civil Procedure Codes.
