On the Legal Nature of a Settlement Agreement

The article is devoted to investigation of the legal nature of a settlement agreement. Various opinions on the legal nature of a settlement agreement have been analyzed and the author’s point of view has been demonstrated. Corresponding cases have been investigated. In the context a considered theme, it is also a very curious question of the possibility of establishing responsibility for failure to perform conditions of a settlement agreement in the agreement. Some authors believe that a settlement agreement is unacceptable to establish penalties for violation of assumed obligations. And others believe that the inclusion in the text of settlement agreements sanctions for violation of conditions under such agreements do not contradict the legislation. Judicial practice is not always unified in this matter. The impossibility of being subjected to provisions of the Civil Code of the Russian Federation on contracts in its entirety shows the difficulty of considering a settlement agreement exclusively as a civil transaction (contract), but also it cannot be considered as only procedural phenomenon.
