Actual Procedure of Election and Qualitative Composition of Elected Magistrates of the Province of the Don Cossack Host in the Second Half of the XIX Century

The article is devoted to legal analysis of results of reform processes of courts in the Russian Empire in the mid-nineteenth century and their impact on the internal structure of the Province of the Don Cossack Host, which was divided into 25 global sites. It is established that the election of justices of the peace, representing at that time a remarkable event like close to the capital and remote from it districts, has not always been easy, in the legal way. Cases when that happened in the election itself could become the subject of proceedings in the magistrates’ court are reviewed and analyzed. It is proved that the election procedure could significantly differ from those offered in modern legal, including educational, literature. Reasons for the increased public interest in the acquisition of the status of magistrates and the procedure of its election are examined. As an illustration, the authors show and comment published in archival materials information about the qualitative composition of justices of the peace of the Province of the Don Cossack Host in the second half of the XIX century, occurred in fact examples of elections, as well as the qualitative composition of elected justices of the peace in the Province of the Don Cossack Host in the second half of the XIX century. Scientific analysis is grounded in materials of periodicals of the Province of the Don Cossack Host of the reviewed period of time, a part of which is still not introduced into scientific circulation.
