The Organization of Civil Proceedings in the Republic of Serbia

THE ORGANIZATION OF CIVIL PROCEEDINGS 
IN THE REPUBLIC OF SERBIA

This article describes the main characteristics of the judicial system in the Republic of Serbia. Fundamental judicial principles were laid down in the Constitution of Serbia of 2006. In the Republic of Serbia are courts of General and courts of special jurisdiction, the competence of which is regulated by the Law on the organization of courts. The purpose of this article is the courts that resolve civil cases. The Supreme Court of Cassation, the highest court, and Constitutional Court, with its extended powers in civil procedure has been given special attention. The trend of transmission of judicial authority in undisputed cases, and enforcement through delegation of judicial powers to the state notaries and bailiffs has also been carefully studied. In conclusion, it was shown the problems faced by the judicial system of Serbia in negotiations with the EU.
