The article deals with the scientific views on the direct application of acts of the European Court, regardless of the country-defendant (erga omnes), and the practice of such application for 2013–2015 in civil procedure of the Russian Federation and Germany. Among other things, the tendencies of territorial asymmetry of judicial activity, inherent in both countries, as well as other characteristics that may be used for formation of a national legal policy in this sphere.
