Legal Force of Judicial Decision under French Civil Procedural Law

The article analyzes the Institute of the legal force of judicial decisions under French civil procedural law. For example, the French experience is invited to reconsider the timing of the acquisition of some of the properties of the force of a judicial decision. The court’s decision either confirms or creates a substantive relationship, which is its main function. In order to ensure the effectiveness of the substantive consequences of a judicial act, it is also endowed with certain procedural features: the presence of the authority of the judgment, its enforceability, granting the probative value of an authentic act. The doctrine to talk about the «triple identity» as the principle of determining the identity. Note the subtle point – we are not talking about the identity of claims, and the identity of the new action and decision, i.e. identity must be a new claim and judgment handed down in the previous claim. Upon presentation of the second claim in respect of which there is any doubt the identity of the first, it does not compare to the original claim, but is compared with the decisions taken on the initial claim, because that decision has the property exclusivity. Therefore, these elements are the elements of the judgment itself, not the suit.
