Class Actions in the Theory of Civil Procedural Law

This article analyzes the class actions from the point of view of the theory of civil procedural law. In general, the claim is made up in the form prescribed by law, a written statement of a certain person based on his or her right to appeal to the court for the purpose of rendering the correct decision in a civil case in accordance with the substantive and procedural law. The main difference of a class action lawsuit from the lawsuit in the usual, broad sense of the term is in the assertion of claim to the court for rendering a court decision that protects the rights and legitimate interests of a group of people. Direct class actions – actions brought in court to protect the legitimate rights and interests of many other persons, or containing the demands against a group of defendants. Derivative class actions – actions of participants of legal entities to their governing bodies for damages caused by the legal entity governing body (derivative actions), a statement challenging the legal acts of the governing agencies of the Russian Federation, violating the rights and legitimate interests of an indefinite range of persons (mass administrative actions).
