The Institute of astreinte in Russian Law: Prospects of Application

The article examines the use of overseas institutions astreinte as a special means of encouraging the debtor to enforce decisions awarding it to do or refrain from certain action. Describes its concept, properties, foreign regulation (in particular, its application in France, Italy, Germany, Portugal, the Benelux countries) and correlation with other mechanisms to ensure the enforcement of judicial decisions, as well as perspectives and ways of introducing the institution astreinte in Russian practice. The article describes the main aspects of the regulation astreinte as compensation for non-judgment, in the operative part of which is an indication of the defendant committing certain actions based on the position generated by arbitration courts in the Resolution of the Plenum of the Supreme Arbitrazh Court of the Russian Federation of April 4, 2014 No. 22 «On Some Questions of Award to Creditor Cash Flows for Failure to Execute Judicial Act». Conclusion about the positive prospects of development of the Russian analogue for astreinte as a means of stimulating comply with a judgment debtor.
