On the Law of the Promissory Note of a Creditor to Apply to the Court with the Claim without Showing a Promissory Note to the Principal Debtor for the Proper Enforcement

The author analyzes the question about the order of presenting the bill for payment including the courts’ activity in this issue and the judicial practice on the designated subject. Demand for payment filed in the place other than the place specified in the bill as the place of payment cannot be considered as the proper way. Consequently, the protest for non-payment provided without the provision of bills for payment at the place specified in the bill as the place of payment cannot be considered as proper evidence of lack of payment and be grounds for satisfaction of recourse claims followed from the bill. A creditor who is unable to refute the objections of the debtor about the absence of direct presentation of bills for payment is considered delinquent. If the bill had to be brought in one term, but it was not presented, then the creditor shall be entitled to present the bill to the principal debtor during the entire period of limitations (three years from the date of maturity). Wherein he would be required to implement his right as well as he would have carried out within the time specified in the document.
