On the Question about the Features of the Consideration of Individual Complaints in Order of Para. 2 of Art. 333 and Para. 5 of Art. 244.6 of the Civil Rrocedure Code of the Russian Federation

The paper analyzes the procedure for dealing with individual complaints on appeal in a civil proceeding. The author notes that the provisions of para. 2 of art. 333 and of para. 5 of art. 244.6 of the Civil Procedure Code of the Russian Federation that fixed different procedures for handling individual complaints to the court of first instance, depending on the procedural issue on which the contested decision was made. It does not fully take into account the consequences of that entails legal procedural matter for the applicant. As a result, persons who are in a similar legal situation will defend their rights in the various civil process procedures that violates the principle of equality of rights to judicial protection and creates an element of discrimination of some participants in the proceedings before the others. Provisions possibility of the court of appeal of self-selection procedures for handling privacy complaints does not correspond to the will of the parties involved in the case, that is inconsistent with the principle of optionality. Replacing individual notification of persons involved in the case on the time and place of the hearing by public offering of the information inside the court of appeal, and on his official website created obstacle for the parties to civil proceedings of different social groups, technical limitations, property and territory character on access to this information. This results in unequal access to judicial protection and the inability for some stakeholders to take part in the hearing and implement procedural rights under art. 35 of the Code of Civil Procedure of the Russian Federation, which violates their right to judicial protection.
