The Legal Nature of Cases on Restoration of Lost Judicial Proceedings in Civil and Arbitration Proceedings

In the article the author provides a historical analysis of the regulation of cases of recovery of lost court proceedings, revealed the legal nature and essence of the cases of restoration of lost court proceedings in civil and commercial («arbitrazh») proceedings, analyzes the validity of the assignment to a particular category of cases in civil proceedings, as well as put forward proposals for improvement of the legal regulation in the different category of cases. Category of cases to restore the lost proceedings allows the individuals, who were participated in a civil case, to restore the production of documents in the special proceeding of the lost production, they need to realize their rights and legitimate interests, as well as prevent violation of the rights of others. Particularly it is interesting the rate of para. 11 of the Regulations, that allows the court, in case of insufficiency of material (documents) collected and in case of the exhaustion of all means of recovery «to resort the re-production of already produced legal action... as it seems necessary for the further movement of the case», including a judicial review of the case. At the same time, the author notes that the procedures for dealing with the restoration of the lost proceedings in the commercial («arbitrazh») process is necessary to put into the appropriate procedural form in the absence of an appropriate procedure in the commercial («arbitrazh») process.
