State Participation in Civil process: Historical and Legal Analysis

The article deals with the history of state involvement in civil proceedings in Russia and abroad, the article also highlights the current needs and trends in the participation of the Russian Federation, Russian Federation entities and municipal entities in civil proceedings. The author notes that the pre-revolutionary procedural law for the first time systematically foothold features of participation of the state in civil proceedings and that was reflected in serious democratic reforms. As the result, the courts of justice are carried out their procedures at a much higher level than in the pre-reform period. The author concludes that in the changed socio-economic conditions and the unnecessarily priority to protect public property and public interest in general, the need for a systematic study of problems of direct participation of public-law entities in civil proceedings is not just exhausted. Acquired a new, but no less of great importance, procedure, which is rooted in the need to increase the responsibility of the state to its citizens and organizations, maintaining a balance of private and public interests, the protection of individual rights against unlawful acts, actions and decisions of the authorities. This requires a systematic scientific analysis and identification of premises, forms and methods of participation of the Russian Federation, Russian Federation entities and municipal entities in civil proceedings as a whole and in its individual forms.
