Enforcement proceedings generate much discussion and raise many questions. They are
the final part of a civil action and, at the same time, the beginning of the lengthy and
challenging process of debt collection. Hence the discussion in academia and doctrine about
which field of law regulates enforcement proceedings. There are several points of view to
be sure. Some assert they are a part of civil procedural law; others argue they are a part of
administrative law. This article presents arguments from the point of view that enforcement
proceedings fall within an independent field of law. They are not a part of civil procedural
law, nor of administrative law. They contain the four elements of an independent field of
law: subject of legal regulation, method, principles and codified legal rules. The subject of
legal regulation differs from that of civil procedural law and administrative law. Method is
also different. Particular principles apply such as immunity, proportionality of the measure
of enforcement and impossibility of enforcement on the person of the debtor or the debtor’s
family. While there is no special enforcement proceedings code in the Russian Federation,
there are two special laws, “On Enforcement Proceedings” and “On Bailiffs”, both laid
down in 1997, and which together form codified legal rules.
