NEGOTIATION TECHNOLOGIES IN LEGAL EDUCATION

The article reveals the possibility of introducing negotiation technologies into the standards of
legal education. The authors point to the existence of objective factors that make it necessary
to study negotiation technologies in the preparation of lawyers. Such a main factor is the
legalization of negotiation on the conclusion of contracts in substantive legislation and
negotiation on the settlement of disputes in procedural legislation. The presence of new
rules requires their study, understanding of the prerequisites for their development, proper
interpretation and application in practice. At the same time, the negotiation mechanism
itself, which is a communicative interaction, lies outside the scope of law. Moreover, the
effectiveness of negotiations, the achievement of the desired legal results, largely depends on
the level of communication of the participants, which includes the possession of negotiation
technologies. In this regard, in terms of content, teaching should be carried out in two
interrelated areas: the legal aspects of the use of negotiations and the general theory of
negotiations, their organization and conduct. From the point of view of the structure, the
negotiation components should be included at all levels of legal education – in undergraduate,
graduate, as part of continuing education. The authors consider various exemplary options
for teaching negotiation technologies at each of these levels.
