MOOT COURTS AND CIVIL PROCEDURE TRAINING

In recent decades, students of Russian law faculties and law schools have shown great
interest in participating in various kinds of moot courts, primarily in international ones:
The Philip C. Jessup International Law Moot Court Competition, the Willem C. Vis Moot
and others. In the legal community, there is an opinion that model student processes are
a highly effective way to train qualified lawyers for further judicial work, primarily as
a judicial representative. Fully sharing this opinion and having experience in preparing
student teams for moot courts, the author turns to the history of the issue, analyzes moot
courts as a tool for educational activity and a way to teach practical skills in the field of civil
procedure. The positive aspects of this type of training are considered, the reasons for the
effectiveness of such a variety of student training are analyzed. At the same time, the thesis
is substantiated that the preparation for participation in model trials cannot be a universal
educational technology. Since such teaching of students is extracurricular and at the same
time highly resourceful for both the student and the teacher (trainer), in the conditions
of limited time and the richness of curricula, the use of this educational technology is
possible only for a small number of students – students who have high academic results
and the desire to spend their free time on the trainings and participation at moot courts.
The conclusion about the inadmissibility of replacing the main educational activity with
training for moot courts is justified.
