SEARCHING OF AN OPTIMAL MODEL

In this article, the authors considered in comparative legal terms the history of the development
of class actions in the USA and Russia. The key moments of legal history and judicial practice
that have influenced the modern system of class actions in civil procedure of the USA and
Russia are shown. The basic models of protecting collective interests in civil and administrative
legal proceedings of Russia that were established for the adoption of Federal Law No. 191
of 18 July 2019 are disclosed, and a brief description of the new class action model, which
comes into force on 1 September 2019, is given, its advantages and problematic issues are
shown. At the end of this comparative study, the authors conclude that by the middle of 2019
in the Russian process there were three legal models for protecting large groups of citizens:
according to the Civil Procedure Code, the Code of Arbitration Procedure and the Code of
Administrative Procedure, each of which differs in several aspects from friend, the degree of
“convenience” for the plaintiffs and the content of the trial. Another result of the comparative
analysis is the formulation of recommendations by a foreign lawyer and a comparison of
the two legal systems and the conclusion that in many ways the US class action model was
the basis of legislative work in Russia.
