The author of the article considers the interaction of substantive and procedural law, and

draws attention to the correlation of substantive and procedural in the current specifics

of legislative activity. There is a different methodology of the relationship of law and

procedure in substantive and procedural law. Historically private law is derived from

the procedural. According to the author, of particular importance in the formation of the

existing separation of law and procedure was the paradigm of the law-forming significance

of will and expression of will, which was transformed in the procedure into the substantive

concept of the claim and the right to claim. The private law system that emerged from

the claims system had a reverse effect on the understanding of the relationship between

the claim and the law, law and defense, substantive and procedural. The author analyzes

the emergence of the paradigms of ius-actio and actio-ius. The author also notes the

importance of understanding the idea that the procedural form and its procedures are not

a derivative of substantive law, and the civil procedure is not an applied “application” of

substantive law. The relationship of law and procedure is not causal in nature.
