THE PRINCIPLE OF ESTOPPEL AND THE REQUIREMENT
OF GOOD FAITH DURING EVIDENTIARY ACTIVITIES
FOR CIVIL CASES

On the example of regulations on evidences and proof the author illustrates that the
principle of estoppel – the idea that the unfair and contradictory behavior has to attract
loss of the right of the party for denial, finds its place in the Soviet and Russian procedural
legislation, in particular in the rules of law regulating admitting facts, non-presentations
proofs by the party, evasion from participation in expert examination. This principle is
the basis for institute of a prejudice, the impossibility of submission of new proofs to the
court of appeal, etc. It is revealed by the author that the latest amendments limiting the
possibility of presentation of evidence to the court within certain terms and providing
other adverse effects of inaction and indiscipline during proof have been accepted without
real guarantees that the conscientiousness or dishonesty of the party can be taken by court
into account in a certain case. It is proved in the article that in order to develop further
in the provisions of the Russian procedural legislation regulating evidentiary activities for
civil cases the estoppel idea it is necessary to understand that requirements of good faith
behavior of the parties is primary in this idea. And loss of the right for denial is secondary.
This is the consequence of unfair behavior and not on the contrary.
