IN RUSSIAN AND ENGLISH CIVIL PROCEDURE

The article is devoted to the institute of disclosure of evidence. In connection with the
reform of civil and arbitration procedural legislation is considered the novel of Article 56
of the Civil Procedure Code of the Russian Federation on the introduction of disclosure of
evidence in civil proceedings. The opinions of scientists on the purpose to disclose evidence
in the arbitration process are analyzed. The article focuses on the disclosure of evidence in
England. This is due to the fact that historically England is the birthplace of the institute of
disclosure of evidence, which has been significantly changed as a result of the reform of the
English procedural legislation. The part 31 of the Civil Procedure Rules of England has been
studied, such part regulates in detail the actions and interaction of the parties to identify
evidence and preliminary acquaintance with them. The two stage procedure, in which the
parties provide each other with access to documents, is described in sufficient detail. At the
first stage the party discloses the document by stating that the document exists or existed. At
the second stage the inspection of the opened document takes place, i.e. the party for whom
the document is disclosed, has the right to examine this document, except for some cases.
