DEVELOPMENT OF THE THEORY OF FORMAL EVIDENCE
AND ITS IMPACT ON MODERN CIVIL PROCEDURE

The article analyzes the theory of formal evidence in legal procedure, its historical
development and its impact on proving in modern civil litigation of Russia. The authors
consider the classical approach to formal evidence in continental law, as well as the standards
of proof in civil and criminal cases in common law countries and the role of Anglo-
Saxon evidence law in establishing formal criteria for assessing evidence. The original
system of evidence evaluation created by Russian and Soviet scientists on the basis of synthesis
of continental and common law in conjunction with the principles of socialist justice
in civil and criminal cases is provided. The modern attitude to free evaluation of evidence
on the internal belief based on a comprehensive, full, objective and direct research
of the evidence available in the case is introduced. According to the authors’ approach the
features of the theory of formal evidence have always existed in the domestic civil proceedings.
A special approach to understanding the institution of admissibility of evidence
in civil procedure, is explained by the influence of the theory of formal evidence. A new
attitude to the science of civil procedure, a broad approach to understanding the theory
of formal proofs is proposed. The conventional historical periodization of the development
of the doctrine of formal evidence is introduced. Possible prospects of application of this
theory in modern justice in particular the use of mathematical methods in the individual
assessment of the evidentiary situation by identifying the resolved case with the volume
of already resolved cases of a certain type are analyzed.
