Reforming of the Revision System of Judicial Acts. Review on the Conference, Organized by the Department of Civil and Arbitration Procedure of the Omsk F.M. Dostoevsky State University

The subject of the article is a legislative initiative, announced by the Supreme Court in the
second half of 2017 – two Resolutions of the Plenum of the Supreme Court of the Russian
Federation, containing the draft laws concerning the judicial system of Russia and some
issues of the proceedings. Following the results of discussion both positive, and ambiguous
aspects of the offered changes in the structure of courts, in the legal procedure are revealed.
The principles of creation of arbitration courts and courts of general jurisdiction are
considered, and there is some answers to the question how new courts will fit into the
judicial system of the Russian Federation. The article analyses the relationship between
the jurisdiction and functions of the courts. Crystallize the functions of the courts can be
both through the creation of new judicial institutions, and by revising the rules of subject
jurisdiction. The definition of the type of proceedings not less interesting problem of the
consequences of making a mistake on this issue, and establish that only in an appellate
court. Also it is noted that a number of the provisions stated in bills demand careful
judgment and assessment from the point of view of the principles of civil, arbitration,
administrative procedure and also formulation of these norms.
