Non-Execution of a Court Decision as the Reason for Applying of Civil Liability Measures

In the article the question of possibility of applying civil liability measures against the debtor for his non-execution of the court decision is analyzed. According to the author, the court decision is a judicial fact both of substance and procedural law. After rendering of the court decision and giving a document obtained by process to enforce, a debtor has only one responsibility to enforce it in correct way in favor of the creditor the earlier obligation, which is announced with the court decision. That execution of the court decision always leads to execution of the obligation that existed between two parts of the process before the rendering of the court decision. Non-execution of the court decision that was rented during civil or arbitration case is an offence against civil procedural law. Consequently, non-execution of the court decision is a judicial fact which is followed by realization of the civil liability measures. The following measures of the civil liability can be applied to a debtor in case he does not enforce the court decision: damage, percent for using other people’s money and court forfeit. As a result, the author comes to conclusion that non-execution of the court decision is an independent reason for applying of the civil liability measures.
