Economic Analysis of Civil Procedure

Civil procedure is a complex and multifaceted legal phenomenon. A fundamentally new platform for studying civil procedure and procedural law can be the economic analysis of law, because according to some estimates, today it is the most advanced interdisciplinary field of legal research. The article evolves the previous author’s publications devoted to the application of the economic analysis of law as a prospective method of civil procedure study. A brief review of «civil procedure and economics», its economic goals, economic analysis of procedural law and its norms is given. The author develops the Shavell’s basic economic theory of civil litigation, applies law and economics analytical principles to costs and trial expenditures, procedural terms and delays, costs of erroneous judgments, procedural evidences, agreements, court judgments and appeals. As a result some conclusions on prospective ways of increasing Russian civil litigation effectiveness as well as on civil procedure economic analysis, are offered.
