Some Aspects of the Use of Information Technologies in Enforcement Proceedings

Information technologies in the sphere of court proceedings with competent use may significantly reduce or facilitate the path to judicial protection and restoration of violated rights and legitimate interests. However, same as it is in civil procedure, information technologies used in enforcement proceedings cannot improve the quality of justice or solve problems of ineffective execution of judicial acts. Moreover, the introduction and active use of new technologies does not necessarily lead to an increase in the accessibility of justice in general. The article reviewed the prerequisites for use and gives an overview of information technologies used in enforcement proceedings. The author analyzes such electronic information systems as a personal area of the party of enforcement proceedings, as well as an Electronic Information System of the Federal Bailiff Service. With reference to the foreign experience of the use of information technology, the article presents some of the trends in Germany’s enforcement proceedings. Prospects for further development of information technologies in enforcement proceedings are considered in the final part of the article in the context of the need to take into account such factors as efficiency and usability of enforcement proceedings for the parties; the author gives some perspective lines of development of information technologies in enforcement proceedings.
