Paired Categories in Civil Procedure (on the Example of Principles of Branches of Law)

 Despite the large number of monographic works and scientific articles written on the topic of the principles of civil proceedings, one should not consider that there are no unexplored sides of the category under consideration. The specificity and rich content of this category implies the search for new aspects. The article investigates principles of civil procedure as elements of pair categories, their detachment in a branch of law, interaction with the other elements as a part of a pair category and their sources of development. In the author’s opinion, any principle of civil procedural law can be considered as an element of a paired category. The author examines the doctrine and gives examples of his understanding of this topic; expresses the opinion that the appearing of new principles (in the doctrine of the civil process) is not reasonable as there are no guarantees for their implementation. The article gives examples and analyzes various bases for constructing paired categories; examples where elements may or may not constitute a pair category, and from this the author comes to the conclusion of possibility or impossibility of considering such elements as the principles of civil procedure. Thus, the author brings the reader to the idea that the isolation of independent, qualitatively different elements of the pair category has practical and theoretical meaning.
