Deprivation of Parental Rights and Traditional Family Values: Procedural Aspects of Harmonization

Family conflicts should not lead to unnecessary removal of a child from a family. If to look for courts practice of the Russian Federation on deprivation of parental rights, there is a tendency of diminution of quantity of sustained actions overall, but in case of Vladimir region, there we can see the other situation. The author analyzes the correlation of the principle of priority of family upbringing of the child and of the legal institute of deprivation of parental rights. The legal nature and the procedural peculiarities of consideration of civil cases on deprivation of parental rights are researched. In the Russian family law, foundations for deprivation of parental rights are evaluative, that makes it difficult to consideration by courts of cases on deprivation of parental rights. The author offers recommendations for improving the current legislation and judicial practice aimed at the harmonization of traditional family values and the legal institution of deprivation of parental rights; analyzes legislation and legal definitions, gives examples of court practice.
