Коллизионное регулирование соглашений о международной подсудности

В настоящей статье исследуется вопрос о допустимости применения иностранного процессуального и материального права к отдельным аспектам соглашения о международной подсудности. В статье предлагается концепция, в соответствии с которой соглашение о международной подсудности представляет собой процессуальный договор, на который распространяются положения материального права о толковании договора и совпадении воли сторон. Таким образом, процессуальная действительность соглашения о международной подсудности должна устанавливаться в соответствии с процессуальным правом страны суда, а в случаях, предусмотренных международным договором и lex fori, в соответствии с иностранным процессуальным правом. Толкование соглашений о международной подсудности и установление действительности согласия стороны на заключение соглашения о международной подсудности должны производиться в соответствии с правом, применимым к основному договору. Применение lex fori и lex causae к соответствующим положениям соглашения о международной подсудности позволит наиболее правильно разрешать соответствующие вопросы, возникающие в связи соглашением о международной подсудности.
