Основные нововведения реформированного Регламента ЕС о юрисдикции и признании и исполнении решений

В статье автор исследует основные изменения, произошедшие в Регламенте ЕС о юрисдикции и признании и исполнении решений в 2012 г., которые начнут действовать в начале 2015 г. Отмечается, что изучение европейского опыта процессуальной гармонизации оправданно как с теоретической (его заимствование возможно при разработке будущих законодательных основ евразийской интеграции), так и с практической стороны (судопроизводство в странах ЕС может непосредственно затрагивать граждан и юридических лиц РФ). При этом исследуемый Регламент представляет особый интерес, поскольку является основополагающим актом Европейского Союза в сфере гражданского процесса. Внесенные в акт изменения и дополнения условно можно подразделить на четыре группы: 1) те, что уточняют сферу взаимодействия судопроизводства по Регламенту и арбитража (исключенного из сферы его действия); 2) те, что частично распространяют сферу действия Регламента на стороны, не домицилированные в ЕС; 3) те, что дополняют правила о параллельных и взаимосвязанных разбирательствах, устанавливая приоритет юрисдикции избранного сторонами суда перед судом, первым принявшим иск к рассмотрению, а также допуская применение указанных правил в случае возникновения процесса в третьем государстве; 4) те, что реформируют процесс признания и исполнения решений, отменяя необходимость получения предварительной декларации исполнимости (экзекватуры) в запрашиваемом государстве. В рамках статьи отмечаются как позитивные моменты, связанные с внесенными поправками, так и негативные, а также обращается внимание на пробелы и упущения авторов реформ.
