АПЕЛЛЯЦИЯ И КАССАЦИЯ В ГРАЖДАНСКОМ ПРОЦЕССЕ: СОВРЕМЕННЫЕ РЕАЛИИ И ПЕРСПЕКТИВЫ

В статье анализируются особенности апелляционной и кассационной инстан- ций в гражданском процессе, акцентируется внимание на необходимости совер- шенствования проверочных производств в цивилистическом процессе в целях эффективности реализации права на судебную защиту. Современные провероч- ные инстанции в гражданском процессе имеют свои особенности, к которым относится не только порядок апелляционного рассмотрения, содержащий в себе элементы полной и неполной апелляции, но и введение двух ступеней кассаци- онной инстанции: первой (сплошной) кассации и второй (выборочной) касса- ции. Указанные особенности отечественных проверочных инстанций в системе судов общей юрисдикции выгодно отличают их от существовавших ранее в Рос- сии и имеющихся ныне в зарубежных правопорядках. Тем не менее существует несовершенство правового регулирования стадий апелляционного и кассационно- го обжалования в гражданском процессе, которое требует скорейшего разреше- ния. В заключении автор приходит к выводу о том, что правовое регулирование порядка апелляционного судопроизводства и производства в кассационном суде общей юрисдикции в гражданском процессе, регламентированный объем полномо- чий судей проверочных инстанций, в том числе с учетом формирующейся судеб- ной практики, нуждаются в соответствующих изменениях.

The article analyzes the peculiarities of appeal and cassation instances in civil proceedings, focuses on the need to improve the verification proceedings in civil proceedings in order to effectively implement the right to judicial protection. Modern verification instances in civil procedure have their own features, which include not only the order of appeal consideration, containing elements of full and incomplete appeal, but also the introduction of two stages of cassation instance: first (continuous) cassation and second (selective) cassation. These fea- tures of the domestic review instances in the system of courts of general jurisdiction favor- ably distinguish them from those that existed earlier in Russia and are currently available in foreign legal orders. Nevertheless, there are imperfections in the legal regulation of the stages of appellate and cassation appeal in civil proceedings, which need to be resolved as soon as possible. In conclusion, the author concludes that the legal regulation of the proce- dure of appellate proceedings and proceedings in the cassation court of general jurisdiction in civil proceedings, the regulated scope of powers of judges of review instances, including taking into account the emerging judicial practice, need appropriate changes.
