ЗАРОЖДЕНИЕ СОВЕТСКОГО ГРАЖДАНСКОГО ПРОЦЕССА: ГПК РСФСР 1923 ГОДА

В 2023 г. исполнилось 100 лет со дня принятия первого Гражданского процессу- ального кодекса РСФСР 1923 г. ГПК РСФСР 1923 г. был принят через шесть лет после Революции, до этого суды руководствовались Декретами, в которых, конеч- но, не содержались все ответы на вопросы гражданского процесса. Однако сразу было невозможно создать новый процессуальный кодекс, комиссия несколько лет работала над проектом, который лишь в 1923 г. превратился в Кодекс. Несомнен- но, перед судоустройством и судопроизводством стояли определенные задачи, и ГПК РСФСР 1923 г. должен был им соответствовать. Так, среди задач можно выделить защиту завоеваний пролетарской революции, интересов и прав трудя- щихся, укрепление общественно-трудовой дисциплины, революционной законно- сти в личных и имущественных отношениях граждан, хотя отдельно статьи, посвященной задачам и целям в ГПК РСФСР 1923 г. Тема симпозиума была обо- значена, как «Проверочные инстанции в системе судов общей юрисдикции (к 100- летию первого ГПК РСФСР 1923 г.)», в статье рассматривается только кассаци- онное производство, как проверочное производство постановлений судов первой инстанции, не вступивших в законную силу. Возникновение и развитие судебно- го надзора в советском гражданском процессуальном праве и его сущность в дан- ной статье не анализируется.

In 2023, it was 100 years since the adoption of the first Civil Procedure Code of the RSFSR in 1923. The Civil Procedure Code of 1923 was adopted six years after the Revolution; before that, the courts were guided by Decrees, which, of course, did not contain all the answers to the questions of civil procedure. However, it was immediately impossible to cre- ate a new procedural code; the commission worked for several years on the project, which only in 1923 turned into a Code. Undoubtedly, the judicial system and legal proceedings faced certain tasks, and the Civil Procedure Code of the RSFSR of 1923 had to comply with them. Thus, among the tasks one can highlight the protection of the gains of the proletari- an revolution, the interests and rights of workers, the strengthening of social and labor dis- cipline, revolutionary legality in the personal and property relations of citizens, although there is a separate article devoted to the tasks and goals in the Civil Procedure Code of the RSFSR of 1923. The topic of the symposium was designated as “Verification instances in the system of courts of general jurisdiction (by the 100th anniversary of the first CPC of the RSFSR in 1923)”, the article considers only cassation proceedings as verification proceed- ings of decisions of the courts of first instance that have not entered into force. The emer- gence and development of judicial supervision in Soviet civil procedure law and its essence are not analyzed.
