SYSTEMATIZATION OF RULES ON CONCILIATION PROCEDURES AND ITS MAIN CHARACTERISTICS (in Accordance with the Federal Law of 27 july 2019 no. 197-FZ)

In this article the author analysis the main characteristics of systematization of rules on
conciliation procedures which was introduces in Russian procedural legislation by the Federal
Law of 27 July 2019 No. 197-FZ. Systematization made by legislator is viewed through
the prism of three criterions: 1) compliance with scientific concepts about conciliation
procedures; 2) compliance with public needs; 3) compliance with the principles of civil
process – optionality, judicial independence and judge’s management of the process. The
main conclusions of the study are as follows. Systematization of conciliation procedures
meets all the author’s parameters. In the Federal Law of 27 July 2019 No. 197-FZ the idea of
empowerment for conciliation was developed. The most important thing now is to adjust the
role of the court in the application of conciliation procedures. This should be the next stage
of development of rules about conciliation procedures in Russian procedural legislation.
