On the Temporal Aspect of the Application of Part 8 of Article 291.6 of the Arbitration Procedure Code of the Russian Federation

One of new term for appeal which was appeared by reforming of the system of cassation appeal in the frame of arbitration proceedings is the term of appeal against an official of the Supreme Court of the Russian Federation an judgement of a judge of the Supreme Court of the Russian Federation about refusing the transfer of a cassation appeal, a submission, which were submitted according with article 291.1 of the Arbitration Procedure Code of the Russian Federation for consideration in the court session of the Judicial Board of Economic Disputes of the Supreme Court of the Russian Federation. But more significant sign of this term in practice is that it is not established directly. And certainty of that term is obviously necessary, in particular, to avoid further accusations of arbitrariness of the implementation of the official of the Supreme Court of its discretionary powers. This article examines the actual temporal aspects of the implementation of this power in arbitration procedure, which, in fact, have not yet become the subject of special research. The author gives examples of judicial practice and the judgments of the European Court of Human Rights concerning the temporal aspect of appeal of the definitions of the Supreme Court of the Russian Federation.
