General Provisions on Representation in Administrative Court Proceedings of the Russian Federation

The article presents a comprehensive study of the rules of the Administrative Court Proceedings Code of the Russian Federation (ACPC RF), which administer general provisions of the institution of legal representation. The author contemplates the issues relevant to ensuring the right to participation of a legal representative in court proceedings; dwells on the peculiarities of provision of legal aid to incapable, incapacitated or underage persons, as well as some other categories of administrative defendants; scrutinizes the procedure of conducting of administrative cases on behalf of legal entities, governmental bodies and local authorities. Special focus is given to the requirements imposed on persons, which may act as the legal counsels, particularly to one of the principle procedural innovations of ACPC RF, i.e. an imperative clause on higher legal education of the counsels, yet documentary proof of compliance with specific requirements. Finally, the author arrives at the conclusion that the concept of legal representation in administrative court proceedings, new to national law, is quite successfully implemented in the ACPC RF.
