Novels of Justice of the Peace Work as a Factor of Civil Procedural Legislation Improvement

Increasing of the role of judicial branch of government in nowadays society gives the need in improvement of organizational structure with the goal to formulate effective mechanisms for adjudication. Practice of functioning of the institute of justice of the peace in Russia today leads to the conclusion that input of the institute became a part of the process of forming real and effective judicial system. The article gives research of some issues of old and new institutes of civil procedure which were tested through work of justice of the peace, in context of legal positions of the Plenum of the Supreme Court of the Russian Federation and counting their influence on development of civil procedure norms. Such issues as expanding the scope of decisions without reasoning part issued by courts of general jurisdiction, improvement of the application process of the norms of the jurisdiction institution in civil procedure are analyzed. The authors consider law enforcement practice of the institute of justice of the peace in Russia and give recommendations for discussions of the project of new Civil Procedure Code of the Russian Federation.
