Impact of Sanctions Regimes on Civil Procedure

A.A. Mokhov,
Doctor of Legal Sciences, Professor at the Kutafin Moscow State Law University (MSAL)

The article considers the impact of sanctions regimes on civil procedure. Differentiation and specialization of the legislation, certain types of economic activity, integration processes, as well as the entry of the Russian Federation in «a sanctions war» are reasons for the increased interest in legal regimes in theory of law. We should note that proclaimed goals of imposed sanctions regimes often do not coincide with real reasons. Input sanctions, as a rule, do not remain without a response, and there are counter-sanctions in response to them. The catalogue of specific measures (both primary and response) in one way or another «war of sanctions» is different and they depends on geographic, political, economic, social, ethnic, cultural and other characteristics of the state. The author singles out characteristic features of the sanctions regime, and offers some measures for the improvement of the Russian procedural legislation during the period of sanctions (counter-sanctions).

Keywords: sanctions regimes; special legal regime; impact of sanctions and countersanctions on the Russian legislation, and also activity of organizations and citizens; arbitration procedure; civil procedure; consideration of sanctions (counter-sanctions) in civil procedure; improvement of the procedural legislation.
