Administrative Proceedings in the Russian Federation: Myth or Reality? (Or a Dispute Between Processualist and Administrativist)

The article is devoted to problems of allocation of administrative proceedings. The author notes that estimates of the «newborn» on the part of representatives of science of civil procedure law, to put it mildly, more than restrained. And representatives of the science of administrative law due to the adoption and entry into force of the Administrative Procedure Code of the Russian Federation are in a state of euphoria. We can agree that at this stage of development of the Russian legislation it is hardly reasonable to raise the question on that the Administrative Procedure Code of the Russian Federation should be abandoned, say, cancel it in accordance with the law. No doubt, this question is not quite realistic. In addition, because of many reasons and not least the mentality of Russian citizens, disputes of a public law nature comes to the consideration of domestic courts are relatively few. In principle it is possible to agree with the appearance of terms such as «administrative action», «administrative claimant» and «administrative party» in the Administrative Procedure Code of the Russian Federation, although some colleagues those terms don’t like. It is clear that these terms are intended to distinguish the claim of a public law nature from a civil lawsuit, although terms «claim» and «claimant» and «defendant» conform to refer to these concepts. But this is not the main thing. Given terms are intended to emphasize that in such cases there is a dispute about the law, and this argument carries publicly-legal character. Accordingly, the parties to the dispute have administrative authority to accept the claim, reject the claim etc.
