Proxyship as a Kind of Free Legal Aid in Civil Procedure

The article describes proxyship at the court, provided under the state system of free legal aid; it analyzes the structure of legal facts which are necessary for the genesis of such proxyship, and determines the place of this kind of proxyship in the classification for reasons of genesis. It also covers restrictions on the realization of the right to free legal aid in the form of proxyship established by the applicable procedural legislation and the Federal Law «On Free Legal Aid in the Russian Federation»; it describes the author’s position on existing restrictions, its correlation with the practice of the European Court of Human Rights, the highest judicial courts of the Russian Federation. If we consider grounds for the emergence of proxyship under a system of free legal aid, we can say that there is definitely a legal basis. Legislation must contain clear and understandable criteria under which a person is entitled to apply for appropriate aid. From these positions such proxyship close to legitimate, as in cases established by the law a person is entitled to use the appropriate form of legal assistance. However, only indication of the law on the availability of appropriate opportunities for the person in and of itself does not lead to the emergence of proxyship. A person is entitled, but not obliged to have the assistance of a proxy, and may participate in the proceedings independently. At the same time, legal proxyship is characterized by the complete replacement the represented party by his proxy, accordingly, such person cannot act in the process on their own. The article proposes mechanism of compensation of state expenses for free legal aid in the form of proxyship.
