Transnational Corporations: Issues and Features of Its Participation in Civil Procedure

In the article the question of participation of companies which represent an extensive network of structural divisions which are worldwide as one of the parties of legal procedure is considered. Also the attention is paid to the nature of TNC, history of their origin, their signs, problems of determination of the personal law of corporation. The International Court of Justice in case «Barcelona Traction» of 1970 established that «there is no certain way of determination of accessory of the legal entity certainly to this or that state», but today there are several various theories for determination of applicable law, all of them are considered in this article. Besides, principles of international civil procedure, practice of participation of corporations as defendants in legal procedures, a role of the Alien Tort Claims Act in accountability of TNC for human rights violations are considered, procedural difficulties which claimants face, submitting a claim within the Alien Tort Claims Act, are analyzed. Violation of human rights by corporations is an urgent problem, at the present stage the world community is faced by a task of creation of more effective mechanism of involvement of TNC to responsibility. It can be done, having only combined efforts of various states.
